SALE CONDITION

This site has been created for the sale to private consumers of wines, in compliance with Italian regulations on distance contracts. Purchases can only be made by individuals of legal drinking age.

The sale is governed by these General Conditions, as well as by the detailed methods indicated in the sections of this site called Privacy Clause and Delivery Methods, which are to be considered an integral and substantial part of the sales contract. Therefore, the Customer is invited, before placing an order, to carefully read the aforementioned sales conditions and the information contained therein, and to print or save them on another durable medium accessible to them.

Any changes or new sales conditions will be promptly communicated to the Customer, will be effective from the moment of publication on the site, and will apply only to sales concluded after the publication.

The Customer’s order submission constitutes acceptance of the sales conditions in force at that time.

CONCLUSION OF THE CONTRACT

The order sent by the Customer to Tenute di Farternita Srl s.a.unip. through the Internet must be completed in its entirety and must contain the necessary elements for the identification of the Customer and the ordered products, as well as the indication of the place of delivery, under penalty of nullity. Tenute di Fraternita Srl will send the Customer an order confirmation by email or other form of communication, containing a reference to the applicable sales conditions.

PRODUCT CHARACTERISTICS AND AVAILABILITY

Tenute di Fraternita Srl undertakes, in accordance with the law, to promptly inform the Customer of the possible unavailability of the ordered product. In the case of the purchase of products with variable weight (products weighed and packaged following a specific order from the Customer), there may be a deviation between the ordered quantity and the actually delivered quantity, with a consequent deviation in weight and price. The actual weight is determined at the time of product preparation and may vary by up to 10% from the measurement indicated in the order. In this case, the Customer will be required to pay the price corresponding to the quantity of product actually delivered, with the understanding that the charge to the Customer can never exceed that indicated at the time of the order.

DELIVERY

Tenute di Fraternita Srl delivers the product or products ordered by the Customer, under the conditions expressly indicated in the section of this site called Delivery Methods.

PRICES AND PAYMENT METHODS

The prices of the products indicated in the various sections of this site include VAT. The applied prices are those indicated on the site at the time of the Customer’s order. The prices of individual products are subject to change, and therefore, the prices indicated on the site at any given time cancel and replace those previously indicated.

The price of the purchased products, together with the cost of home delivery, must be paid by the Customer at the time of the online order, via Paypal or advance bank transfer. Purchases made on this portal are secure and guaranteed.

Payment by advance bank transfer In case of payment by advance bank transfer, the order will be processed only after receiving confirmation of the credit from the bank. Communications related to payment and the data provided by the customer at the time of payment take place on dedicated secure lines.
Payment with PayPal By selecting the PayPal payment method, you will be redirected to a PayPal website page where you will enter your email address and password and make the payment, which will be automatically split between Tenute di Fraternita Srl for the products and the courier for the shipping. PayPal fees are borne by Tenute di Fraternita Srl and are therefore included in the order summary. Your financial data will not be shared with Tenute di Fraternita Srl but will be managed directly by PayPal. In case of order cancellation or non-acceptance by Tenute di Fraternita Srl, the amount will be refunded to your PayPal account. Tenute di Fraternita Srl will not be responsible for delays and/or damages caused during the refund process.

REFUND

In case of order cancellation or non-acceptance by Tenute di Fraternita Srl, the amount will be refunded using the same method used for the order (Bank Transfer or Paypal).

FISCAL DOCUMENTATION:

Fiscal documentation will be provided by Tenute di Fraternita Srl at the time of delivery.

To request copies of documents (receipt, invoices, etc.), the Customer can contact Tenute di Fraternita Srl via email at info@tenutedifraternita.it or by phone at +39 0575 24694, always remembering to indicate the type and number of the document for which a copy is requested.

WARRANTIES AND LIABILITY

Tenute di Fraternita Srl, within the limits of availability as regulated above, guarantees that products identical to those indicated and described on the site will be delivered. It guarantees compliance with all regulations regarding product preservation until the moment of delivery to the location indicated in the order. For all products sold, the manufacturer’s responsibility applies. In the case of packaged products, the manufacturer is also responsible for the accuracy and completeness of the information on the packaging. The images on the site are provided to the Customer to facilitate product recognition; due to variations in packaging by the manufacturer, the photos may not exactly reflect the appearance of the delivered product.

DELIVERY METHODS

Once the order and payment are received from the Customer, Tenute di Fraternita Srl arranges for pickup with the shipping company (usually one to two pickups per week). Once the products are picked up, the goods are delivered in Italian territory within 24/48 hours.

If the goods are not picked up, they will be held in storage and returned to the sender: the Customer will therefore be required to pay the full redelivery cost.

ORDER AND SHIPPING STATUS INFORMATION

For each shipment, the Customer has the option to request, by email at info@tenutedifraternita.it, the tracking number related to the shipment of their order through which they can check the status of the shipment on the website of the courier/transporter used, or through its call center.

SHIPPING COSTS

The cost of transportation will be calculated by the system based on the weight and/or number of ordered items.

For gift packages in cardboard boxes, there may be a deviation from the weight calculated by the system and consequently an increase in transportation costs.

FREE SHIPPING: For orders over €150, delivery in Italian territory is provided free of charge by Tenute di Fraternita Srl.

DELIVERY

To ensure proper service in terms of time but also product safeguarding (e.g., breakages during transport), we rely on specialized couriers for the transportation of quality wine.

In case the recipient is not reachable, the goods will go into storage, and therefore the delivery amount must be repaid.

IMPORTANT! AT THE TIME OF DELIVERY, CHECK THAT:

the package is intact, not damaged or wet
the quantities correspond to those you ordered.

In case of damage or shortage, we suggest accepting the delivery with a check reservation and contacting us immediately at info@tenutedifraternita.it: this way, the Customer has the opportunity to calmly verify the order’s conformity, and Tenute di Fraternita Srl will have the possibility to recover from the courier in case of anomalies.

For oil cans, dents in the can that do not cause liquid leakage from the inside cannot be considered reimbursable damages.

CANCEL OR MODIFY AN ORDER

To modify or cancel an already placed order, it is necessary to promptly contact Tenute di Fraternita Srl via email at info@tenutedifraternita.it or by phone at +39 0575 24694, always indicating the reference order number.

DISPUTES AND APPLICABLE LAW

Civil disputes regarding the application, execution, and interpretation of the distance sales contract are subject to Italian jurisdiction, and the competent court is the Court of Arezzo. Distance contracts with Tenute di Fraternita Srl are governed by Italian law, and, for what is not expressly provided, the legal norms apply.
